We may collect information that you voluntarily provide, including when you email us, suggest a listing, request a correction, report an issue, ask a question, submit feedback, or otherwise communicate with us. Such information may include your name, email address, telephone number, organization, message content, listing information, supporting documents, and any other information you choose to provide.

Do not send Social Security numbers, financial account information, medical records, detailed diagnoses, treatment records, insurance information, government identification numbers, or other highly sensitive information. The Service is not designed to receive or store medical records or protected health information and is not a secure medical-communication system.

04. SEARCH AND LOCATION INFORMATION

When you use the search features, you may enter a ZIP code, city, state, radius, age range, activity category, population category, cost preference, schedule preference, or other filters. These entries are used to generate search results. Search parameters may also appear in a website address, server request, diagnostic record, or technical log.

You should not enter a child’s name, diagnosis, exact home address, medical condition, school, or other personal or sensitive information into a search field. A ZIP code, city, or state entered for search purposes may relate to your general area, but The Service does not need your exact residential address to provide ordinary directory results.

08. LISTING SUGGESTIONS AND CORRECTION REQUESTS

If you suggest a listing, request a correction, or report a concern, we may use the information you provide to investigate the matter. We may contact the listed organization, consult public sources, or share relevant portions of your submission when reasonably necessary to verify the information or address the request.

We are not required to keep a submission confidential. Do not include information that you do not want reviewed, retained, or shared for the purpose of evaluating the listing or request.

09. SERVICE PROVIDERS

We may use third-party providers for website hosting, database services, file storage, content delivery, security, email, analytics, mapping, error monitoring, and related infrastructure. These providers may process information on our behalf or receive technical information necessary to provide their services.

Current or future providers may include services such as Vercel, Neon, Vercel Blob, Google Maps, email providers, domain providers, and security or diagnostic vendors. Providers may change over time. Their handling of information may also be governed by their own agreements and privacy policies.

10. GOOGLE MAPS AND MAPPING / NAVIGATION SERVICES

The Service may provide links to Google Maps or use mapping, address, location, route, navigation, geocoding, or place information supplied by Google or another third party. When you open or use such features, the third-party provider may receive information including the address or location requested, your device information, your Internet Protocol address, and other information described in the provider’s own privacy policy.

The Service does not currently sell personal information for money and does not currently operate a targeted advertising program. If our practices materially change, we may update this Privacy Policy and provide any notices or choices required by applicable law.

113. THIRD-PARTY SERVICES AND TRANSACTIONS

Any communication, registration, payment, donation, purchase, waiver, contract, visit, transportation arrangement, attendance, participation, refund request, dispute, injury claim, or other interaction with a listed organization or third party is solely between you and that third party.

The Service is not a party to those interactions and is not responsible for prices, charges, deposits, refunds, cancellations, representations, contracts, conduct, goods, services, injuries, discrimination, accessibility, privacy, security, or outcomes.

114. VISITING OR NOT VISITING A PROGRAM IS AT YOUR OWN RISK

You may use any information on The Service only at your own risk. You are solely responsible for decisions to contact, visit, not visit, register with, pay, rely on, travel to, participate in, withdraw from, or avoid any program or activity.

To the fullest extent permitted by law, The Service and the Platform Parties are not responsible or liable for any injury, illness, death, abuse, neglect, discrimination, emotional distress, property damage, financial loss, missed opportunity, delay, transportation problem, privacy incident, or other harm arising from or related to visiting or not visiting, using or not using, or relying or not relying on any program, activity, listing, link, map, distance, or information mentioned on the website.

115. PERSONAL SUPERVISION AND SAFETY RESPONSIBILITY

Parents, guardians, caregivers, and participants are responsible for appropriate supervision, transportation, emergency planning, medical preparation, medications, allergy precautions, mobility assistance, behavioral supports, communication supports, equipment, clothing, consent forms, waivers, and other needs.

Never assume that a program provides medical staff, one-to-one supervision, personal care, transportation, adaptive equipment, emergency medication administration, or any other support or services.

116. EMERGENCIES

The Service is not an emergency service and does not monitor communications continuously. Do not use the Services to request emergency assistance or report an immediate threat.

In an emergency, call 911 or the appropriate local emergency service. For medical, mental-health, abuse, neglect, or safety concerns, contact qualified professionals or the appropriate governmental or emergency authority.

117. NO RIGHT TO BE INCLUDED IN THE DATABASE

No person, family, business, nonprofit organization, school, government entity, program, activity, facility, service provider, advertiser, sponsor, or other party has a right or entitlement to be included, displayed, indexed, ranked, categorized, verified, or retained in the The Service database.

Submitting a listing or correction does not require us to review, accept, publish, respond to, or retain it. We may decline any submission for any reason or no stated reason, subject to applicable law.

118. OUR RIGHT TO CONTROL LISTINGS

We may, at any time, with or without notice, and for any lawful reason or no stated reason:

(a) add, reject, remove, hide, suspend, restore, or discontinue a listing; (b) edit, shorten, expand, rewrite, correct, format, translate, or reorganize listing information; (c) change categories, population labels, cost labels, schedules, age ranges, verification status, photographs, links, ordering, ranking, or visibility; (d) combine duplicate listings or separate one listing into multiple listings; (e) refuse or remove information that is incomplete, inaccurate, outdated, unsafe, unlawful, misleading, promotional, inappropriate, or inconsistent with our purposes; and (f) discontinue any category, location, feature, search method, or database content.

We have no obligation to provide advance notice, an explanation, an appeal, compensation, traffic, referrals, or continued listing availability.

119. LISTING OWNERS AND BUSINESSES

A business or organization may contact us to suggest a correction, request review, or provide updated information. We may ask for evidence of authority, ownership, affiliation, accuracy, or identity, but we are not required to accept the request.

A listing is part of our independently managed directory. Except where applicable law requires otherwise, a listed organization does not control the wording, categories, placement, verification status, search ranking, or continued existence of its listing.

120. USER SUBMISSIONS, FEEDBACK, AND SUGGESTIONS

If you submit listing information, corrections, photographs, descriptions, comments, ideas, feedback, or other material, you represent that you have the right to provide it and that it is accurate to the best of your knowledge.

You grant The Service a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, edit, adapt, verify, store, publish, display, distribute, and otherwise use the submitted material for operating, promoting, improving, and maintaining the Services, subject to applicable law.

Do not submit confidential, proprietary, defamatory, infringing, unlawful, deceptive, or harmful material. We may use suggestions without compensation, attribution, approval, or obligation to implement them.

121. INTELLECTUAL PROPERTY

The Services, including their original text, organization, selection, compilation, database structure, design, software, branding, graphics, and functionality, are owned by or licensed to The Service and are protected by applicable intellectual-property laws.

Third-party names, logos, photographs, trademarks, and content belong to their respective owners. Their appearance on The Service does not imply affiliation or endorsement.

122. LIMITED PERMISSION TO USE THE SERVICES

Ordinary search-engine indexing that complies with our technical instructions is not prohibited by this section. We may block, rate-limit, investigate, or take legal action against unauthorized automated or bulk access.

125. SERVICE AVAILABILITY AND CHANGES

We do not guarantee that the Services will be available, uninterrupted, secure, error-free, complete, or compatible with every device or browser. The Services may experience outages, delays, bugs, attacks, maintenance, data loss, provider failures, or other problems.

We may modify, suspend, restrict, or discontinue any part of the Services at any time without notice or liability. We have no obligation to preserve any listing, feature, search result, communication, or historical version.

126. CORRECTIONS AND REPORTING CONCERNS

You may report suspected errors or concerns to InclusionPlanet@Yahoo.com. We may review a report but do not guarantee a response, correction, removal, investigation, or completion date.

Reporting an issue does not transfer responsibility for your decisions to The Service. Until information is independently verified directly with the relevant organization, you should assume that any listing may contain errors.

The Service DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, SAFETY, QUALITY, LEGALITY, ACCESSIBILITY, NON-INFRINGEMENT, TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND THAT THE SERVICES WILL MEET YOUR NEEDS OR PRODUCE ANY PARTICULAR RESULT.

128. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, The Service AND ITS OWNERS, OPERATORS, ADMINISTRATORS, VOLUNTEERS, CONTRIBUTORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE “PLATFORM PARTIES”) WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES ARISING OUT OF OR RELATING TO:

(a) ACCESS TO, USE OF, INABILITY TO USE, OR RELIANCE ON THE SERVICES; (b) ANY LISTING, PROGRAM, ACTIVITY, ORGANIZATION, PERSON, FACILITY, PRODUCT, OR THIRD-PARTY SERVICE; (c) ANY ERROR, OMISSION, OUTDATED INFORMATION, INCORRECT CONTACT DETAIL, MAP, DIRECTION, ROUTE, DISTANCE, OR SEARCH RESULT; (d) ANY DECISION TO VISIT, NOT VISIT, PARTICIPATE, NOT PARTICIPATE, REGISTER, PAY, CANCEL, OR RELY ON INFORMATION; (e) PERSONAL INJURY, ILLNESS, DEATH, ABUSE, NEGLECT, DISCRIMINATION, PROPERTY DAMAGE, FINANCIAL LOSS, DATA LOSS, PRIVACY LOSS, OR EMOTIONAL DISTRESS; (f) UNAUTHORIZED ACCESS, MALWARE, SECURITY INCIDENTS, SERVICE INTERRUPTION, OR THIRD-PARTY CONDUCT; OR (g) ANY OTHER MATTER RELATED TO THE SERVICES.

THIS LIMITATION APPLIES WHETHER A CLAIM IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, WARRANTY, OR ANOTHER THEORY, EVEN IF A PLATFORM PARTY WAS ADVISED THAT DAMAGE WAS POSSIBLE.

IF APPLICABLE LAW DOES NOT PERMIT EXCLUSION OF ALL LIABILITY, THE AGGREGATE LIABILITY OF THE PLATFORM PARTIES FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (US $100), OR THE MINIMUM AMOUNT REQUIRED BY APPLICABLE LAW, WHICHEVER IS GREATER.

129. RELEASE OF THIRD-PARTY CLAIMS

To the fullest extent permitted by law, you release the Platform Parties from claims, demands, losses, and damages arising from disputes or interactions between you and any listed organization, participant, employee, volunteer, instructor, service provider, website, map provider, transportation provider, or other third party.

The Service has no duty to intervene in, mediate, investigate, or resolve such disputes.

130. INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Platform Parties from claims, liabilities, losses, damages, judgments, penalties, costs, and reasonable attorneys’ fees arising from or related to your unlawful or improper use of the Services, your breach of these Terms, your submission of content or information, or your violation of another person’s rights.

The Service may control the defense of a matter subject to indemnification, and you agree to provide reasonable cooperation.

131. GOVERNING LAW AND VENUE

These Terms and any dispute relating to the Services will be governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Subject to any non-waivable legal right, any judicial proceeding must be brought in a state or federal court with jurisdiction in Palm Beach County, Florida, and you consent to personal jurisdiction and venue in those courts.

132. TIME LIMIT FOR CLAIMS

To the fullest extent permitted by law, any claim arising out of or relating to the Services must be filed within one year after the event giving rise to the claim. If applicable law does not permit that limitation, the shortest legally permitted period will apply.

133. SEVERABILITY

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted and otherwise severed. The remaining provisions will continue in effect.

134. NO WAIVER

A failure or delay by The Service to enforce any provision does not waive that provision or any other right. A waiver is effective only if expressly made in writing by an authorized representative.

135. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without prior written consent. The Service may assign or transfer these Terms, in whole or in part, in connection with a change in operation, ownership, organization, or service provider, subject to applicable law.

136. ENTIRE AGREEMENT

This Privacy Policy, these Terms of Use, and any additional policies or notices expressly incorporated by reference constitute the entire agreement concerning your use of the Services and supersede prior communications about that use.

137. CHANGES TO THE TERMS

We may revise these Terms at any time. Revised Terms become effective when posted unless a later date is stated. Your continued use after the effective date constitutes acceptance of the revised Terms to the extent permitted by law.

138. HEADINGS AND INTERPRETATION

Headings are for convenience and do not limit the meaning of any provision. Words such as “including” mean “including without limitation.” Singular terms include the plural when appropriate. These Terms will not be interpreted against a party solely because that party drafted them.

(a) DIRECTORY INFORMATION MAY BE WRONG, INCOMPLETE, OR OUT OF DATE; (b) A LISTED PROGRAM MAY NOT BE SUITABLE FOR A PARTICULAR PERSON WITH SPECIAL NEEDS; (c) CONTACT DETAILS, ADDRESSES, HOURS, PRICES, AGE RANGES, PROGRAM TERMS, AND OPERATIONS MAY CHANGE; (d) MAPS, DIRECTIONS, NAVIGATION DATA, AND DISTANCES MAY BE WRONG OR APPROXIMATE; (e) A LISTING IS NOT AN ENDORSEMENT OR GUARANTEE; (f) YOU MUST VERIFY INFORMATION AND SUITABILITY DIRECTLY WITH THE PROGRAM; (g) YOU USE THE SERVICES AND ANY LISTING INFORMATION AT YOUR OWN RISK; (h) NO PERSON OR BUSINESS HAS A RIGHT TO BE INCLUDED IN THE DATABASE; AND (i) The Service MAY ADD, EDIT, HIDE, SUSPEND, MODIFY, OR REMOVE ANY LISTING AT ANY TIME, FOR ANY LAWFUL REASON OR NO STATED REASON.
